Links

Our website contains links to other websites, web pages and services which are not under our control and are not maintained by us. These links are provided for your convenience only and we are not responsible for the content or reliability of these sites. We just like them, that’s all. Using these linked sites means you are operating under their terms and conditions so don’t blame us if they change overnight and start selling nuclear grade plutonium.

Liability

We are not liable for any loss caused to you by late delivery. There are only so many things you can influence. The Delivery page of our website gives you a guide to when your goods will be delivered. As part of the shipping process, an email is sent to you when your goods are dispatched from our warehouse.

We will not be responsible for any losses resulting from your use or the inability to use our website. If this results in unauthorized access to, or alteration of your transmissions or data in circumstances, you can’t blame us.

We will not be responsible for your loss of profits, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

Indemnity

You agree to indemnify, defend and hold harmless TKC Direct Ltd t/a EBTM, its directors, officers, employees, consultants, agents and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your use of EBTM’s services, your breach of the Terms of Service, your infringement of any intellectual property right or any other right of any person or entity, or your breach of any duty of confidence or privacy, or any defamatory statements made by you in any form.

Yes, that last para was written by a lawyer. And it probably cost us four grand.

Retail of Products and Services

You can order products displayed on this website using the secure shopping cart provided. It even has a wobbly wheel.

Once you have placed an order we will send you an email confirming that we have received your order. The email confirmation will be produced automatically so that you have confirmation of your order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your order.

We aim only to display items which are in stock and which can be despatched to you quickly. If we are unable to supply a particular item that you have ordered we will supply the remainder of your order and refund the cost of the out-of-stock item and related shipping fee. In most cases any such refund will be made directly to your credit or debit card. You will be notified of the delivery costs automatically, as part of the checkout process, before you submit your card details.

For more information about our delivery charges see our Delivery page.

We may change or withdraw any part of our website, or may refuse you access to the website at any time if we consider it necessary. Sounds a bit harsh, but you need to be up to no good for us to do this so we won’t feel bad.

Variation of content

EBTM shall have the right in its absolute discretion at any time and without notice to amend, remove or vary any of the content supplied in connection with the Service or which appears on any page of the EBTM.com’s website. But we’re not the fickle fashionista type, demanding pygmy poodles and pink Crystal champagne, so we’ll try not to mess you about.

Right to Cancel

To protect you, our beautifully-clad customers, from scumbags involved in credit and debit card fraud, we reserve the right to cancel any order where the customer uses a credit or debit card issued by a card provider based in a country other than the customer’s delivery address. Or, the toys might also come out of our (tastefully accessorised) pram if the customer doesn't provide the additional information we request to verify their identity and address within five days, or any of the contact details you provide during the registration process turn out to be fibs, or a mail server returns any confirmation email message we send to you. In all such cases we will refund the full amount paid in pounds sterling.

Misuse

You will be responsible if you use this website in breach of these terms of use and will reimburse us for any loss that you cause to us as a result of your misuse.

Hardball, eh? You better believe it.

We make no promise that our website will be uninterrupted or entirely error free. We are human too, you know. Due to the nature of the Internet, the online shopping service is provided on an "as is" and "as available" basis. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control.

Jurisdiction

The laws of England and Wales govern these terms and only the courts of England and Wales will decide any disputes. So if you is a bad mutha, go choke someone’s else’s chain.
